This Notice describes the rights you have concerning the Personal Information we collect about you.  This Notice is applicable to U.S. residents and other clients of ProBooks services about whom we have Personal Information, except:
  • Clients, plan participants, and other individuals who, by virtue of the financial services we provide, have their Personal Information protected by the Gramm Leach Bliley Act (“GLBA”).
  • Employees and contingent workers, and job applicants.

Why Do We Process Personal Information?

We use personal information to better tailor and personalize our services and communications to you and for any other purpose permitted by applicable law, including the following purposes:

With Whom Do We Share Personal Information?

We may share Personal Information at your request or to complete a transaction for which the Personal Information was collected, provide a service to you, assist you in exercising your rights with respect to your information, detect security incidents or illegal activity, conduct our regular business activity including quality assurance and marketing to you, and as required by law (for instance with regulators and law enforcement agencies). In addition, we may use your information to detect security and fraud as well as technical support functions.

Access to Specific Pieces of Information

You may request that we disclose certain information to you about our collection and use of your Personal Information over the past 12 months.
Upon your valid written request, we will provide a report outlining specific pieces of Personal Information collected about you the consumer that you have requested. You may make this request a maximum of two times within a twelve-month period.

Deletion of Personal Information

You may request that we and our service providers delete any Personal Information that we collect from you. Our obligation to comply with this request is subject to exemptions. If you are interested in requesting deletion of your Personal Information, please note we may have a legal reason to retain your information, as permitted by the CCPA, in accordance with the original reason provided for collecting and processing Personal Information as described within this document.
We retain Personal Information in accordance with our information management policies, which establishes general standards and procedures regarding the retention, handling, and disposition of our records, including Personal Information. Personal Information is retained as long as necessary to meet legal and regulatory requirements. Retention may be extended if we are required to preserve Personal Information in connection with litigation, investigations, and proceedings.

Anti-Discrimination

We will not discriminate against you for exercising your CCPA rights.
In order to provide a response, ProBooks may ask that you provide clarifying or identifying information to verify your request. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity and confirm that the Personal Information relates to you.
Agents who make requests on behalf of individuals will be required to verify their authority to make the request by submitting written authorization from the individual. We will not honor any requests from agents until authorization is verified.

Will the U.S. Privacy Policy and Notice Change?

We reserve the right to modify or supplement this Notice at any time. Therefore, we recommend that you review this Notice, updated and posted on this Site, regularly for changes. The Effective Date of this Notice, as stated above, indicates the last time this Notice was revised.

The Websites may use third-party service providers to service various aspects of the Websites. Each third-party service provider’s use of your personal information is dictated by their respective privacy policies; however, we have entered an agreement with them that they will not use your information for any purpose other than the business purposes that are part of our agreement with them. The Websites currently uses the following third-party service providers:
  • HubSpot – this service is used for delivery of email updates and newsletters. HubSpot stores your name and email address for purposes of delivering such communications. This service is also used to provide customer service to our clients. Your IP address, email address, and voluntarily entered information will be stored by Intercom on its servers.
  • Paypal – this service is used for payment processing on ecommerce products. At no time is your banking information passed to the Websites. We receive only information used for order fulfillment and reporting.
  • Stripe – this service is used for payment processing on ecommerce products. At no time is your banking information passed to the Websites. We receive only information used for order fulfillment and reporting.
  • Samcart – this service is used for our ecommerce products. Your personal information may be shared with us for purposes of order fulfillment, customer service, or reporting. You may automatically receive certain correspondence from us related to your order, but your purchase will not automatically add you to any marketing email lists.
  • Kajabi – this service is used to host our ecommerce products. Your personal information is used to create your account and communicate with you regarding the service.
  • Typeform – this service is used occasionally to capture information from our clients. All personal information is voluntarily input and is not required unless a client elects to submit the applicable form. Any information input into the form is saved by Typeform and is accessible to ProBooks staff.
  • Post Affiliate Pro – this service is used to allow us to service our affiliate programs, including products sold by our ProMoney Certified Coaches.
  • Salesmsg and EZ Text – these services are used to provide SMS communications to our clients
  • Leadpages – this service is used to create subscription opt-in pages. Leadpages captures information, which it automatically transfers to Active Campaign.
  • Vidapp – this service is used to host the ProMoney mobile application. Your email address is shared with Vidapp to verify membership.
  • Shopify - this service is used for our ecommerce products. Your personal information may be shared with us for purposes of order fulfillment, customer service, or reporting. You may automatically receive certain correspondence from us related to your order, but your purchase will not automatically add you to any marketing email lists.
  • Merchandise Fulfillment – if you purchase a physical product from the Websites, your information may be forwarded to one of our merchandise fulfillment partners for the purpose of fulfilling your order. You may receive emails regarding shipping or fulfillment, but your purchase will not automatically add you to any marketing email lists.
At this time, your personal information is not shared with any other third-party applications. This list may be amended from time to time in the Websites’ sole discretion.
Except when required by law, ProBooks will not sell, distribute, or reveal your email addresses or other personal information without your consent; however, ProBooks may disclose or transfer personal information collected through the Websites to third parties who acquire all or a portion of our business, which may be the result of a merger, consolidation, or purchase of all or a portion of our assets, or in connection with any bankruptcy or reorganization proceeding brought by or against us.

SMS Terms And Conditions

  • ProBooks offers different text messaging programs, depending on the products/services you purchase. These messages include marketing/product information, as well as account notifications, as indicated below:
    • ProMoney Accelerator: Coaching notifications, event/training reminders, purchase notifications and newsletters for new clients (6 week program).
    • ProMoney Coaching: Coaching notifications, event/training reminders, purchase notifications and newsletters for ProMoney Coaching Membership clients (30 day recurring membership).
    • ProMoney Coaches: Coaching notifications, meeting/training reminders, offers to share with clients and newsletters for ProMoney coaches.
    • ProMoney Marketing: marketing/promotional notifications.
  • You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
  • If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at https://www.probookscpa.com/generalsupport.
  • Carriers are not liable for delayed or undelivered messages
  • As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Website Analytics

The Websites use Google Analytics to analyze traffic to the Websites.
In order to track usage, Google Analytics places a cookie with a randomly generated Client ID on your browser. Google does use your personal information such as your IP address in order to capture reporting for the Websites regarding usage. You may opt-out of Google Analytics through a Browser Add-on, which is available here.

From time to time, ProBooks may use anonymous data, which does not identify you alone, or when combined with data from other parties. Newsletters

On the Websites, you may subscribe to our newsletter, which may be used for advertising purposes. All newsletters sent may contain tracking pixels. The pixel is embedded in emails and allows an analysis of the success of online marketing campaigns. Because of these tracking pixels, ProBooks may see if and when you open an email and which links within the email you click. Also, this allows ProBooks to adapt the content of future newsletters to the interests of the user. This behavior will not be passed on to third parties; however, it is accessible by our email service providers, HubSpot and Google Business.

Affiliate Program Participation

The Websites may engage in affiliate marketing, which is done by embedding tracking links into the Websites. If you click on a link for an affiliate partnership, a cookie will be placed on your browser to track any sales for purposes of commissions.
ProBooks, LLC. is a participant in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means for sites to earn advertising fees by advertising and links to Amazon.com.  As part of this Amazon Associates program, ProBooks will post customized links, provided by Amazon, to track the referrals to their website. This program utilizes cookies to track visits for the purposes of assigning commission on these sales.

Do Not Sell My Personal Information
